A PURCHASE OR PAYMENT WILL NOT IMPROVE YOUR CHANCES OF WINNING.

VOID WHERE PROHIBITED BY LAW.

ALL DISPUTES WILL BE RESOLVED SOLELY BY BINDING ARBITRATION.

ENTRANTS WAIVE THE ABILITY TO BRING CLAIMS IN A CLASS ACTION FORMAT.


1. DESCRIPTION

The 2026 Wonderful Fruit Recipe Contest (the “Contest”) is sponsored and administered by Subarashii Kudamono Limited, 3759 PA-737 #183, Kempton, PA 19529 (“Wonderful Fruit” or “Sponsor“). Participants may enter the Contest beginning at 12:00 a.m. ET on February 9, 2026,and must submit all required materials by 11:59 p.m. ET on April 30, 2026 (the “Entry Period”). The Contest is void where prohibited or restricted by law, is subject to applicable federal, state, provincial, and local laws, rules, and regulations (each, a “Law”), and is governed by these Official Rules.


2. ACCEPTANCE OF THE OFFICIAL RULES; PRIVACY POLICY; LAWS:

By entering the Contest, each entrant unconditionally accepts and agrees to comply with and be bound by these Official Rules and by the decisions of Sponsor, which shall be final and binding on all matters pertaining to the Contest. Information obtained from entrants in connection with the Contest is governed by Sponsor’s Privacy Policy, available on Sponsor’s website. In the event of a conflict between the Privacy Policy or any Contest promotional materials, on the one hand, and these Official Rules, on the other hand, these Official Rules shall control with respect to the Contest. By entering the Contest, each entrant also agrees to comply with all applicable Laws in connection with participation.


3. ELIGIBILITY

The Contest is open to any natural person who, at the time of entry:

– Is a legal resident of one of the fifty (50) United States or the District of Columbia, Canada (excluding Quebec), or any other country in which this Contest is fully permitted by all applicable Laws (excluding Puerto Rico, Crimea, Cuba, Iran, North Korea, and Syria, and excluding any persons prohibited by Law, including individuals on the U.S. Department of the Treasury’s Office of Foreign Assets Control Specially Designated Nationals and Blocked Persons List); and

A) Is at least the age of majority in the entrant’s home jurisdiction (18 years old in most U.S. states).

B) Wonderful Fruit, its advertising and promotion agencies, prize providers, any other company or organization involved with the design, sponsorship, or operation of the Contest, and each of their respective officers, directors, employees, and agents (collectively, the “Wonderful Fruit Parties”), and the immediate family and household members of such individuals, are NOT eligible to enter the Contest. “Immediate family members” means a person’s spouse and a person’s and their spouse’s parents, stepparents, legal guardians, children, stepchildren, siblings, and stepsiblings, and each of their respective spouses. “Household members” means those people who share the same residence, whether or not related.


4. ENTRY REQUIREMENTS:

There is one (1) method of entry into the Contest. An entry into the Contest is referred to as an “Entry.”

A) To enter, each entrant must complete and submit the online Contest entry form (the “Contest Entry Form”) available on the dedicated website for the Contest (the “Contest Site”) prior to the end of the Entry Period. Each Entry must be an original recipe created by the entrant that features one or more Subarashii Kudamono Asian Pear Pantry product(s).

B) There is no limit to the number of Entries an entrant may submit; however, each recipe may be submitted only once. A complete Entry includes all materials and information requested in the Contest Entry Form, uploaded through the entry portal.

C) In addition to any guidelines posted on the Contest Site, each Entry (including the Contest Entry Form and all data, information, images, content, and other materials included in the Entry) must comply with the following:

  • It must be entirely the original work of the entrant.
  • It must not contain any individual’s photograph, likeness, name, voice, or other element of persona or identity unless the entrant has obtained all necessary releases and consents to enter the Entry in the Contest and to grant the rights in the Entry as provided in these Official Rules.
  • It must not infringe, misappropriate, or violate any intellectual property, privacy, publicity, or other proprietary rights of any third party.
  • All information provided must be true, accurate, and complete in all respects.
  • It should not reveal personal information about another individual (e.g., address, phone number, email address, credit card number, or other information that may be used to track, contact, or impersonate that individual).
  • It must not be created or submitted through any script, macro, or other automatic method.
  • It must comply with these Official Rules and all applicable Laws.
  • It must be suitable for publication to a general audience and must not contain anything that:
    • is illegal, abusive, tortious, defamatory, pornographic, sexually explicit, obscene, libelous, invasive of another’s privacy, hateful, or otherwise objectionable;
    • promotes discrimination based on race, ethnicity, nationality, religion, sex, sexual orientation, disability, or age;
    • promotes violence or unsafe or illegal activity;
    • is threatening, harassing, or degrading;
    • impersonates any person or entity or misrepresents an affiliation with any person or entity; or
    • disparages or injures the reputation or goodwill of Wonderful Fruit, any prize provider, or any of their respective officers, directors, employees, products, or services.

D) All Entries must be received by the end of the Entry Period and must be submitted using the online entry portal on the Contest Site. Entries will not be acknowledged or returned. Proof of transmission does not constitute proof of receipt. Incomplete, unreadable, late, forged, or unintelligible Entries, or Entries that are otherwise not in compliance with these Official Rules, are void and will be disqualified. Subsequent attempts by the same individual to submit multiple Entries by using multiple or false contact information, accounts, or otherwise may result in disqualification. Entries generated by script, computer programs, macro, programmed, robotic, or other automated means are void and may be disqualified. Entries submitted by entrants who do not meet the eligibility requirements (including age and residence) are void. In the event of a dispute over the identity of an online entrant, the Entry will be deemed submitted by the registered account holder of the email address associated with the Entry for the domain associated with the submitted address, provided that person is eligible. “Registered account holder” is the person assigned to an email address by an Internet access provider, online service provider, or other organization responsible for assigning email addresses. Winners may be required to show proof of being a registered account holder. If a dispute regarding the identity of the individual who actually submitted an Entry cannot be resolved to Sponsor’s satisfaction, the affected Entry will be deemed ineligible. Sponsor’s designated database clock will be the official timekeeper for the Contest. Those who do not follow all of Sponsor’s instructions, provide the required information in their Entry, or abide by these Official Rules may be disqualified. Sponsor may run multiple campaigns, contests, or other promotions simultaneously. Entry into one (1) campaign or contest does not constitute entry into any other.


5. CONTEST JUDGING AND WINNER DETERMINATION:

A) Eligible Entries will be reviewed by a panel of judges from across the Wonderful Fruit organization.

B) Eligible Entries will be judged using the criteria (the “Criteria”) described below. There will be one round of judging. The judges will base their decisions on the following factors:

  • Creativity and uniqueness of how Subarashii Kudamono Asian Pear Pantry products are used;
  • Creativity and visual appeal of submitted photos or videos
  • How well the Entry captures the essence of the final dish

Three (3) winning Entries (each entrant submitting a winning Entry, a “Winner”) will be selected based on total score under the Criteria. The eligible Entry with the highest total score will be deemed the first-place Winner; the eligible Entry with the second-highest total score will be deemed the second-place Winner; and the eligible Entry with the third-highest total score will be deemed the third-place Winner. In the event of a tie, the tied Entries will be re-evaluated by the judges, and the judges will select the higher-ranked Entry in their sole discretion.


6. CONTEST ADMINISTRATION AND RULES.

Sponsor will have complete discretion over interpretation of these Official Rules, administration of the Contest, and selection of the Winners. Decisions of Sponsor as to the selection of the Winners will be final. The potential Winners will be notified using the information provided during entry by email, telephone call, or other commercially reasonable method (method to be selected by Sponsor in its sole discretion) within a commercially reasonable time after judging. Sponsor is not responsible for false, incorrect, changed, incomplete, or illegible contact information. Notification is deemed to have occurred upon sending of an email or placing of a phone call. Sponsor is not responsible for electronic communications that are undeliverable as a result of any form of active or passive filtering, or insufficient space in an entrant’s email account.


7. CHANCES/ODDS OF WINNING:

The chances of winning a prize depend on the number of Entries received during the Entry Period and the quality of each Entry as evaluated by the judges based on the Criteria described in these Official Rules. A PURCHASE OR PAYMENT WILL NOT INCREASE YOUR CHANCES OF WINNING.


8. PRIZES

The first-place Winner will receive one Seasonal Harvest Box subscription plus three gift boxes to enjoy or share. The second-place Winner will receive two large gift boxes to enjoy or share. The third-place Winner will receive one large gift box to enjoy or share. The distribution of the prizes will be at the sole determination of Sponsor to the individuals deemed to have won the Contest by Sponsor in accordance with these Official Rules.

Prizes are non-transferable, with no cash redemptions, equivalents, or substitutions except at Sponsor’s sole and absolute discretion. All prize details not specified in these Official Rules will be determined in Sponsor’s sole and absolute discretion. Prize details and availability are subject to change and prize provider rules and restrictions, and if Sponsor is unable to provide a Winner with the stated prize, Sponsor may elect to provide the approximate retail value of such item in cash or award an alternate prize of comparable or greater value. Winners are solely responsible for all federal, state, provincial/territorial, and/or local taxes, and for any other fees or costs associated with the prize received, regardless of whether any portion of the prize is used. The value of any prize awarded to a Winner may be reported for tax purposes as required by Law. Each Winner may be required to provide Sponsor with a valid taxpayer identification number before the prize will be awarded for tax reporting purposes. An IRS Form 1099 may be issued in the name of each Winner for the actual value of the prize received. Unclaimed prizes will be forfeited. Prizes, if legitimately claimed, will be awarded. Sponsor is not responsible for, and will not replace, any lost, mutilated, or stolen prize or any prize that is undeliverable or does not reach a Winner because of an incorrect or changed address. If a Winner does not accept or use the entire prize, the unaccepted or unused portion will be forfeited and Sponsor will have no further obligation with respect to that prize. No more than the stated prizes will be awarded. Limit of one (1) prize per person.


9. USE OF PERSONAL DATA: 

All personal information collected by or on behalf of Sponsor (including, without limitation, each entrant’s name, biographical data, and city and state/province of business address) may be used for the administration of the Contest and as described in Sponsor’s Privacy Policy. Please refer to the Privacy Policy for important information regarding the collection, use, and disclosure of personal information by Sponsor. In addition, except to the extent prohibited by Law, by entering the Contest, each Winner grants to Sponsor and its designees the right to publicize the Winner’s name, Entry materials, and award information in connection with the Contest, in any media now known or hereafter devised, throughout the world, in perpetuity, without additional compensation, consideration, credit, notice, or permission.


10. INTELLECTUAL PROPERTY

Upon submission of an Entry to the Contest, the entrant irrevocably grants to Sponsor, and each of its licensees, successors, and assigns, a non-exclusive, perpetual, royalty-free, no-cost license and right to use and otherwise exploit the Entry, and all images, text, and materials included or depicted therein, in whole or in part, in any manner or medium now or hereafter known or devised, throughout the universe and in any and all languages, including, without limitation, the right to display, reproduce, recreate, record, perform, exhibit, distribute, copy, edit, change, modify, add to, subtract from, re-title, and adapt the same, to combine it with other material, and otherwise use and exploit it without compensation or attribution to the entrant or any third party, except for the awarding of the prize to the Winners. Entrants agree that during the Entry Period, they shall not make, and shall not permit, any other public use, display, or distribution of their Entry, and they shall maintain all rights without encumbrances so that, if Sponsor desires, entrants can assign all rights in and to Entries if selected as a Winner. Sponsor, and each of its successors, assigns, and licensees, will have the right to make unlimited derivative works of Entries, to assign or transfer any or all of Sponsor’s granted rights, and to grant unlimited, multiple-level sublicenses. Without limiting the foregoing, Sponsor will have the right to use the Entries submitted as part of the Contest, and all images, text, and materials included or depicted therein (if any), in any merchandising, advertising, marketing, promotion, or for any other commercial or non-commercial purpose. Entrants hereby forever waive and relinquish all so-called “moral rights (droit moral)” now or hereafter recognized in connection with Entries submitted as part of the Contest. Entrants acknowledge that as a condition of participating in the Contest and/or being selected as a Winner, Sponsor may request that the entrant’s Entry, and any rights therein, be assigned to Sponsor and entrants may be required to confirm such assignment by completing and submitting such documents as reasonably requested by Sponsor (the “Assignment Documents”), or the entrant may be disqualified from receiving his/her/their prize(s). Entrants must maintain the ability to assign all such rights to Sponsor free of any limitations, restrictions, or third-party obligations. Entrants agree that Sponsor shall have the sole discretion in determining the extent and manner of its use of Entries and is not obligated to use any Entry. Entrants agree that neither Sponsor nor its agents shall be responsible for the return or preservation of Entries. Each entrant acknowledges that Entries are not being submitted in confidence or in trust to Sponsor and that no confidential or fiduciary relationship is intended or created.

Each entrant acknowledges that Sponsor and other entrants may have created ideas and concepts contained in their Entries that may have familiarities or similarities to his/her/their own Entry, and that he/she/they will not be entitled to any compensation or right to negotiate with the Wonderful Fruit Parties because of these familiarities or similarities. Notwithstanding any custom or practice in the industry to pay an individual for an idea (if any), nothing herein creates an implied or express contract to compensate entrants for their Entries, and there is no obligation for any Wonderful Fruit Party to pay or otherwise compensate entrants for any of their ideas or materials in any communications with Sponsor. Entries are not confidential, and the Wonderful Fruit Parties’ only obligations to entrants regarding Entries are as specifically set forth in these Official Rules. Sponsor reserves the right to request from an entrant at any time proof that the entrant maintains all necessary rights in their Entry, in a form acceptable to Sponsor, in order to grant Sponsor the rights required herein. Failure to provide such proof may lead to disqualification from the Contest, among other remedies.


11. LIMITATION OF LIABILITY:

NEITHER SPONSOR NOR ANY OTHER WONDERFUL FRUIT PARTY SHALL BE LIABLE FOR ANY SPECIAL, INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR RELATING TO THE CONTEST, ANY PRIZE, OR THESE OFFICIAL RULES, HOWEVER CAUSED, WHETHER ARISING IN TORT, CONTRACT, STRICT LIABILITY, OR OTHER LEGAL THEORY, AND REGARDLESS OF WHETHER ANY WONDERFUL FRUIT PARTY WAS ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, ALL OF WHICH ARE DISCLAIMED AND EXCLUDED. ALL PRIZES ARE PROVIDED “AS IS.” THE WONDERFUL FRUIT PARTIES DO NOT MAKE AND HEREBY DISCLAIM ANY WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY (INCLUDING, WITHOUT LIMITATION, ANY IMPLIED OR STATUTORY WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT) WITH REGARD TO THE CONTEST OR ANY PRIZE. By entering the Contest, each entrant (on his/her/their own behalf and on behalf of his/her/their heirs and assigns) releases and holds harmless the Wonderful Fruit Parties from any claims, losses, damages, costs, or other liabilities of any kind, in whole or in part, including economic damages and personal injury (including death), directly or indirectly arising out of or relating to the Contest, these Official Rules, any Entry, or any prize or award.


12. DISQUALIFICATION: 

Sponsor reserves the right, in its sole discretion, to disqualify any entrant who Sponsor finds to be tampering with the participation process or the operation of the Contest or the Contest Site, acting in violation of these Official Rules, acting in an unsportsmanlike or disruptive manner, or acting with the intent to disrupt or undermine the legitimate operation of the Contest, or to annoy, abuse, threaten, or harass any other person. Sponsor reserves the right to seek damages and other remedies from any such person to the fullest extent permitted by Law.


13. TERMINATION/MODIFICATION: 

Sponsor shall have the right to modify, suspend, or terminate the Contest, in its sole discretion, at any time for any reason, including, without limitation, as a result of natural disaster, equipment failure, civil disturbance, fraud, financial or administrative difficulties, technical problems (such as a computer virus/bug), or unauthorized intervention that corrupts the administration, security, fairness, integrity, or proper functioning of the Contest, or other causes not within Sponsor’s control. In addition, if, in Sponsor’s sole judgment, the Contest (or any portion thereof) becomes compromised in any way, Sponsor reserves the right to cancel any method of entry, to void any Entries submitted fraudulently, and/or to select Winners from among all non-suspect eligible Entries received prior to the act that compromised the Contest. Should the Contest be terminated prior to Winner selection, Sponsor will post a notice on the Contest Site and will make alternate arrangements to award the prizes described herein. Sponsor reserves the right to make changes to these Official Rules. Any such changes will become effective upon notice via online posting at the Contest Site or other means of broad dissemination.


14. INTERPRETATION: 

The invalidity or unenforceability of any provision of these Official Rules shall not affect the validity or enforceability of any other provision. If any provision is determined to be invalid, unenforceable, or illegal, these Official Rules shall otherwise remain in effect and shall be construed as if the invalid or illegal provision were not contained herein. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.


15. DISPUTES:

Except where prohibited by Law, each entrant agrees that:

A) any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Contest, but in no event attorneys’ fees; and

B) any and all disputes, issues, questions, claims, and causes of action arising out of, concerning, or connected with this Contest, the construction, validity, interpretation, and enforceability of these Official Rules, the rights and obligations of the entrant and Sponsor in connection with the Contest, or any prize awarded, shall be governed by and construed in accordance with the Laws of the Commonwealth of Pennsylvania, without regard to any choice-of-law or conflict-of-laws principles that would cause the application of the Laws of any jurisdiction other than the Commonwealth of Pennsylvania;


16. ARBITRATION PROVISION: 

By participating in the Contest, each entrant agrees that any and all disputes the entrant may have with, or claims the entrant may have against, the Wonderful Fruit Parties, relating to, arising out of or connected in any way with (i) the Contest, (ii) the awarding or redemption of any prize, and/or (iii) the determination of the scope or applicability of this agreement to arbitrate, will be resolved individually and exclusively by final and binding arbitration administered by the American Arbitration Association (“AAA”) and conducted pursuant to its Commercial Arbitration Rules. The arbitrator’s decision shall be controlled by the terms and conditions of these Official Rules and any of the other agreements referenced herein that the applicable entrant may have entered into in connection with the Contest. Any such dispute or claim shall not be combined or consolidated with any dispute or claim of another person against the Wonderful Fruit Parties, and specifically, without limitation of the foregoing, shall not under any circumstances proceed as part of a class action. There shall be no authority for any claims to be arbitrated on a class or representative basis; arbitration can decide only the entrant’s and/or Sponsor’s individual claims and the arbitrator may not consolidate or join the claims of other persons or parties who may be similarly situated. For any arbitration in which an entrant’s total damage claims, exclusive of attorney fees and expert witness fees, are $5,000.00 or less (a “Small Claim”), the arbitrator may, if the entrant prevails, award the entrant’s reasonable attorney fees, expert witness fees and costs as part of any award, but may not grant the respondent Wonderful Fruit Parties their attorney fees, expert witness fees or costs unless it is determined that the claim was brought in bad faith. In a Small Claim case, an entrant shall be required to pay no more than half of the total administrative, facility and arbitrator fees, or $50.00 of such fees, whichever is less, and the respondent Wonderful Fruit Parties shall pay the remainder of such fees. If any part of this Arbitration Provision is deemed to be invalid or otherwise unenforceable or illegal, the balance of this Arbitration Provision shall remain in effect and shall be construed in accordance with its terms as if the invalid or illegal provision were not contained herein.


17. SPONSOR AND ADMINISTRATOR: 

The sponsor and administrator of the Contest is Subarashii Kudamono Limited, with offices at: 3759 PA-737 #183, Kempton, PA 19529.


18. NO ENDORSEMENT:

Nothing contained in these Official Rules or in any of the Contest materials should be construed as an endorsement by Wonderful Fruit of any third party, product, or service.


19. SOCIAL MEDIA PLATFORMS:

The Contest may be advertised on or accessed through one or more social media platforms, such as Facebook, Instagram, or X. However, the Contest is in no way sponsored, endorsed, or administered by, or associated with, any such platforms. Entrants agree to comply with all terms and policies governing such platforms in connection with the Contest.
